By accessing recruitedfilms.com or purchasing any services, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use this website or purchase any services. If the student athlete on whose behalf services are being purchased is under the age of 18, the parent or legal guardian must read, agree to, and accept these Terms and Conditions on the athlete’s behalf.

1. ACCEPTANCE OF TERMS
By accessing recruitedfilms.com, placing an order, or engaging Recruited Films for any services, you (“Client” or “you”) agree to these Terms and Conditions in their entirety.
If services are being purchased on behalf of a minor athlete, the parent or legal guardian must affirmatively accept these terms. By doing so, they represent that they have full legal authority to bind themselves and the minor to this agreement.
RecruitedFilms reserves the right to modify these Terms and Conditions at any time. Changes will be posted at recruitedfilms.com/terms with an updated effective date. Continued use of the website or services after any modification constitutes acceptance of the updated terms.
2. DESCRIPTION OF SERVICES
Recruited Films produces custom cinematic recruitment films, highlight videos, and photography packages for student athletes. These productions are designed to showcase athletic talent, character, and identity to college coaches, athletic programs, and recruiting personnel.
Specific deliverables, formats, and service details are outlined in the applicable service agreement or invoice provided at the time of purchase.
RecruitedFilms reserves the right to decline or discontinue services at its sole discretion. In such cases, any amounts paid will be refunded in full.
3. PAYMENT TERMS
Payment in Full — Required Upfront
All Recruited Films services require payment in full before any production work begins. No production will be scheduled, initiated, or commenced — including pre-production planning, scheduling, or resource allocation — until full payment has been received and confirmed by Recruited Films.
Payment is considered confirmed when funds have cleared and RecruitedFilms has issued written confirmation via email. A pending transaction does not constitute confirmed payment.
No Payment Plans
Recruited Films does not offer payment plans, installment arrangements, or deferred payment options unless explicitly agreed to in writing by an authorized Recruited Films representative prior to any services being rendered. Verbal agreements regarding payment terms are not enforceable.
Failed or Reversed Payments
In the event that a payment is declined, reversed, or charged back after production has commenced, Recruited Films reserves the right to immediately suspend or terminate services and pursue full recovery of all amounts owed, including any costs incurred in connection with the reversal process.
Refund Policy
Due to the custom and time-intensive nature of our services, all payments are non-refundable once production has commenced.
Exceptions: A full refund will be issued only if (a) Recruited Films cancels the engagement prior to commencement of production, or (b) Recruited Films fails to deliver the agreed-upon final product within a commercially reasonable timeframe through no fault of the Client.
4. INTELLECTUAL PROPERTY RIGHTS
This section governs the ownership and permitted uses of all content produced by Recruited Films. Please read it carefully.
Your Ownership of the Final Product
Upon receipt of payment in full and delivery of the finished content, the Client — or the athlete’s parent or legal guardian on behalf of a minor — retains full ownership rights to the finished video(s) and photographs produced for them. The Client may use, share, distribute, display, and reproduce the content freely for personal use, athletic recruitment, college applications, and educational purposes without restriction.
Recruited Films’ Retained License
Notwithstanding the above, by purchasing our services, the Client grants Recruited Films a perpetual, royalty-free, non-exclusive license to use the finished videos, photographs, clips, excerpts, still frames, and derivative works solely for the following self-promotional purposes:
Organic social media content on any platform, including Instagram, TikTok, YouTube, Facebook, X (formerly Twitter), LinkedIn, and successor platforms.
Display on the RecruitedFilms website, including portfolio pages, testimonials, and case studies.
Paid digital and social media advertising campaigns promoting RecruitedFilms’ services.
Paid promotions on streaming and broadcast channels, including connected television (CTV), over-the-top (OTT) platforms, and linear broadcast, for the purpose of advertising RecruitedFilms’ business.
What Recruited Films Will Never Do
The finished product will never be sold, transferred, sublicensed, or conveyed to any third party for their independent use. Recruited Films’ license is strictly limited to self-promotion of its own services. No commercial exploitation of your content for any purpose other than marketing RecruitedFilms is permitted — ever.
Recruited Films’ Pre-Existing Rights
Recruited Films retains full ownership of all pre-existing intellectual property used in production, including proprietary techniques, editing styles, templates, and creative methodologies. Nothing in these Terms transfers ownership of Recruited Films’ pre-existing intellectual property to the Client.
5. MODEL RELEASE AND LIKENESS RIGHTS
By accepting these Terms and Conditions, the Client — and for minor athletes, the parent or legal guardian — grants Recruited Films the right to photograph, film, and record the athlete’s name, image, likeness, voice, and athletic performance in connection with the purchased services.
The Client authorizes Recruited Films to use such name, image, likeness, voice, and performance footage in all media formats for the self-promotional purposes described in Section 4, without additional compensation.
For athletes under the age of 18, the parent or legal guardian represents and warrants that they are the minor’s legal parent or guardian and have full authority to grant these rights.
A separate Model and Media Release document will be required prior to or at the time of production. Execution of that release is a condition of production. Failure to execute it may result in postponement or cancellation of services without refund.
6. DELIVERY OF FINAL PRODUCT
Recruited Films will use commercially reasonable efforts to deliver the final product within the timeframe communicated at or prior to the time of purchase. Specific timelines are outlined in the applicable service agreement.
Final delivery is deemed complete upon Recruited Films providing the Client with access to finished files via digital delivery link or other electronic means.
The Client agrees to provide timely scheduling availability, required materials, and reasonable cooperation. Delays caused by the Client may extend delivery timelines without penalty to Recruited Films.
Unless a specific revision policy is included in the service agreement, delivery of the final product constitutes satisfaction of Recruited Films’ production obligations. Additional revisions may be subject to fees at Recruited Films’ then-current rates.
7. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, Recruited Films’ total liability to the Client for any claim shall not exceed the total amount paid by the Client for the specific services giving rise to that claim.
Recruited Films is not liable for any indirect, incidental, consequential, special, or punitive damages — including lost profits, lost opportunities, damage to reputation, or failure to achieve any recruitment outcome — even if Recruited Films has been advised of the possibility of such damages.
The Client acknowledges that Recruited Films does not guarantee any specific athletic recruitment result, college offer, or coaching response as a result of the content produced.
8. DISPUTE RESOLUTION
Informal Resolution
In the event of any dispute, the parties agree to first attempt resolution through good-faith informal negotiation for a period of thirty (30) days following written notice of the dispute.
Binding Arbitration
If informal resolution is unsuccessful, any dispute, claim, or controversy shall be resolved by binding arbitration administered by a mutually agreed-upon arbitration service under its then-current rules. Arbitration shall take place in Washington County, Wisconsin.
Governing Law
These Terms and Conditions are governed by the laws of the State of Wisconsin. For any matters not subject to arbitration, the parties consent to exclusive jurisdiction and venue in the state and federal courts of Washington County, Wisconsin.
Injunctive Relief
Either party may seek emergency injunctive or equitable relief from a court of competent jurisdiction to prevent irreparable harm, including unauthorized use of intellectual property.
Class Action Waiver
To the extent permitted by law, the Client waives any right to participate in a class action lawsuit or class-wide arbitration against RecruitedFilms.
9. PRIVACY AND COPPA COMPLIANCE
Recruited Films is committed to protecting the privacy of all Clients, including minor athletes. All data collection and use is governed by our Privacy Policy, available at recruitedfilms.com/privacy, which is incorporated into these Terms by reference.
Recruited Films does not knowingly collect personal information from children under the age of 13 without verifiable parental consent. All services involving minor athletes require active parental or guardian participation in the intake, consent, and production process.
Recruited Films will not sell or share personally identifiable information about athletes or their families with third parties for marketing purposes.
10. GENERAL PROVISIONS
These Terms and Conditions, together with any applicable service agreement, invoice, and separately executed Model and Media Release, constitute the entire agreement between the parties and supersede all prior agreements or understandings.
If any provision of these Terms is found unenforceable, it will be modified to the minimum extent necessary, and all remaining provisions will continue in full force.
The Client may not assign or transfer any rights or obligations under these Terms without prior written consent from Recruited Films.
Recruited Films shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including acts of God, weather, illness, or other circumstances outside Recruited Films’ control.
